HC bans transfer of IAS,IPS and IFS officers in UP
LUCKNOW: In a major set back to UP government, the Allahabad high court on Tuesday banned the transfer of IAS, IPS and IFS officers till the recomposition of the Civil Services Board and adherence to the recent amendment in IAS cadre rules.
A division bench of Chief Justice
DY Chandrachud and Justice DK Arora passed the order on a PIL filed by a
local NGO, Lok Prahri. The PIL, which was filed in 2011, demanded fixed
tenure for the officers of All India Services.
Petitioner and
former IAS officer, SN Shukla,
said the Supreme Court had passed an
order on October 31, 2013, directing the Central government to ensure
fixed tenure for the officers of the said services within three months.
In compliance of the order, the Centre recently fixed a two-year tenure
for these officers. The Centre also directed the state governments to
recompose the Civil Services Board which would look into the transfer of
these officers.
Shukla alleged the state government is transferring these officers without recomposing the board or following the new rule.
